Protection of human rights of arrested persons in India

Abstract

Human rights are legal rights that are available to all people regardless of their caste, creed, and gender, place of birth, religion, or geography. The idea of human rights states that all people who are detained or imprisoned must be treated with humanity and respect since they are also human beings. As a result, they should be entitled to the same basic human rights as everyone else. There are several international agreements that address the rights of such arrested individuals. At the national level, these rights are also acknowledged as basic rights in Part III of the Indian Constitution. The Code of Criminal Procedure, 1973 also protects the rights of those arrested. The purpose of this article is to provide an overview of the rules that bestow and defend the interests and rights of an arrested person.
