A study of protection of domain name trademarks under the Russian Federation network environment

Abstract

This study examines the legal frameworks and practices for protecting domain names and trademarks in Russia's digital environment, highlighting the challenges posed by the internet and the need for stronger legislative measures. It analyzes current laws, judicial practices, and international comparisons to identify gaps and suggest improvements to trademark protection online.With the growth of e-commerce, robust legal protections for trademarks on the Internet are increasingly necessary. Despite progress in Russia's Civil Code, unresolved issues persist in protecting trademarks in the digital space. This paper delves into these challenges and the required legislative responses.The research uses a comprehensive methodology, including systemic analysis and comparative legal studies, to evaluate current regulations and propose enhancements. It focuses on issues like the illegal use of trademarks, cybersquatting, and domain name disputes.The study concludes that while Russia has advanced its trademark laws for the digital age, further refinement is needed. Adopting international best practices, such as the UDRP, and improving judicial processes are essential for stronger trademark protection online. This research lays the groundwork for ongoing legislative development and better enforcement to safeguard trademark rights in the digital era.
