Abstract

In this article, the author analyzed the opening of banks, their organizational and legal form and banking operations. The purpose of this study is to develop proposals and conclusions aimed at improving the procedure for opening banks and banking operations based on the results of the study. In order for banks to participate in the financial market, they must first undergo state registration. The Central Bank, as a state body and bank of banks, supervises the activities of banks, in particular, carries out state registration and issuance of licenses for the creation of banks. These processes are carried out in two stages: first, the applicant receives preliminary permission to open a bank, and then takes the appropriate steps to obtain a license. The necessary documents and actions for opening banks are clearly and definitely defined in the legislation. However, these processes are quite complex and time consuming.By studying these issues through a comparative analysis of domestic and foreign legislation, historical, legal, systemic, logical, statistical and other methods, proposals have been developed to systematize the requirements for opening banks in national legislation and banking activities. These proposals are used in scientific activities, lawmaking, law enforcement, interpretation of banking legislation, and improvement of national legislation. The main content of the activities of banks is banking operations and they are somewhat different from banking services.Banking operations are related to the financial activities of the bank, while banking services are more related to its organizational activities.
